Such new terms and conditions will be posted on Notifact's website. Further, Visitors who use Notifact's
services or purchase products through the Notifact website, shall be subject to
other terms and conditions in other agreements. To purchase such products or receive the services, the Visitor must
agree to be bound by the terms and conditions in such other agreements.

and Limitation of Liability
Visitor expressly agrees that use of the
Notifact website is at Visitor's sole risk.
Notifact does not warrant that (i) the Notifact website will be
uninterrupted or error-free; or (ii) any information posted on the Notifact

NOTIFACT MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR

MATERIALS OR PRODUCTS, INCLUDED ON THIS WEBSITE. NOTIFACT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING
BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE. NOTIFACT WILL NOT
BE LIABLE FOR ANY DAMAGE OF ANY KIND ARISING FROM THE USE OF THIS WEBSITE,
INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND

Intellectual
Property
Visitor acknowledges that all material
("Material") on or used by the Notifact website is either owned by or
licensed to Notifact and is protected by various copyright laws and other
intellectual property protection laws, rules or regulations. Visitor may not modify, remove, delete,
augment, ad to, publish, transmit, participate in the transfer or sale of,
create derivative works from, or in any way exploit any of the Materials, in
whole or in part. Visitor may make
copies of select portions of the Materials, provided that the copies are made
only for Visitor's personal use and that Visitor maintains any notices
contained in the Material, such as all copyright notices, trademark legends, or
other proprietary rights notices.
Registration
Visitor agrees to provide true, accurate,
current and complete information about Visitor as required by the registration
page of the Notifact website. Further,
Visitor agrees to maintain and promptly update the registration data to keep it
true, accurate, current and complete.
If Visitor does not provide accurate information, Notifact may at its
discretion, terminate Visitor's member account, cease to provide any services
or cancel any orders placed by Visitor.
Membership
Upon filling out the appropriate registration
page on the Notifact website, Visitor will receive a password and account
designation. It is Visitor's
responsibility for maintaining the confidentiality of the account designation
and password and Visitor is fully responsible for all activity conducted under
Visitor's account and password. Visitor
will not give Visitor's password or account information to any third
party. Visitor will immediately notify
Notifact of any unauthorized use of Visitor's password or account or of any
other breach of security. Notifact will
not be liable for any loss or damage arising from Visitor's failure to comply
with the terms of this section.
Submitted
Information
If Visitor sends any message or communication to
Notifact, such message or communication will be the property of Notifact and
will not be returned. Notifact shall
have the right to use, reproduce, modify, adapt, publish, translate,
distribute, and display such messages or communications, including the
Visitor's name.
Privacy
When a Visitor enters the Notifact website,
Notifact collects some basic information.
This includes which pages are visited, types of products purchased, and
any feedback from the Visitor. Notifact
then aggregates this information with other pieces of information to improve
the Notifact website and make the Visitor's experience on the Notifact website
as valuable and efficient as possible.
Notifact uses cookies to speed navigation, keep track of items, and
provide Visitor with custom-tailored content. Notifact may also use cookies to
remember information the Visitor gave Notifact so the Visitor doesn’t have to
reenter it each time Visitor enters the Notifact website. Notifact reserves the right to use the
information collected whether by cookies or the registration page for any
lawful purpose, including passing such information to third parties.

Visitor acknowledges that each third party web site may be governed by its
own rules and regulations and that the Visitor will adhere to such rules and
regulations when visiting such third party web site. Notifact shall have no liability whatsoever for any actions of
the Visitor on such third party web sites nor will Notifact be liable for any
information or data downloaded by Visitor or any transaction entered into while
visiting such third party web site.
Applicable
Law
This Agreement shall be governed by and
construed in accordance with the laws of the State of New Jersey without regard
to conflicts of law provisions thereof.
Both parties agree to the exclusive jurisdiction of the state and
federal courts of New Jersey.
